Police have upgraded charges against a driver involved in an alleged high-speed crash that killed two young boys in Sydney.
Jimmy Martin Brito, 33, has been charged with two counts of aggravated driving causing death while travelling at a speed more than 45km/h over the limit.
Brito appeared at Sutherland Local Court on Thursday and was refused bail.
He is expected to appear in court again on November 30.
The crash took place on The Grand Parade at Monterey in Sydney's south, when Brito's Subaru Impreza sedan left the road and hit a tree.
The road has a speed limit of 60km/h.
Brito was previously charged with two counts of dangerous driving causing death, and one count of causing bodily harm by misconduct.
Each of the upgraded charges carries a maximum 14-year jail term.
Police allege Brito lost control of his car, which crossed to the wrong side of the road before the collision.
His passengers, two brothers aged nine and 10, were treated at the scene by paramedics before being taken to the Sydney Children’s Hospital, where they later died.
A nine-year-old girl was also taken to the same hospital after the crash. She survived with minor injuries.
Police have been investigating whether the vehicle was involved in street racing at the time of the crash.
Investigators were also hunting for the driver of a grey sedan seen driving alongside the Subaru before it struck the tree.
