Former Cricket Aus exec guilty of sexually touching men

A former cricket executive has been found guilty of sexually touching two men without their consent.

Cricket Australia's (CA) former head of communications Timothy Joseph Whittaker contested the two charges in Melbourne Magistrates Court last month.

One of the men said Whittaker touched him without his consent in the early hours of March 16, 2019, following a CA end-of-season function at his Abbotsford apartment.

The man was asleep on Whittaker's couch when the other guests left and woke up in Whittaker's bed with the 38-year-old touching him. 

Another man said Whittaker had inappropriately touched him in bed after a night out drinking, in January 2016. 

That incident did not come out until 2021 when the man disclosed it to CA's people and culture manager. 

Whittaker resigned as CA's head of communications on March 15, 2019, to take up another position at the International Cricket Council in Dubai.

Magistrate Tim Gattuso found Whittaker guilty of both charges on Thursday afternoon.

Prosecutors asked the magistrate to order Whittaker to apply for bail given the guilty finding.

But Mr Gattuso allowed Whittaker to remain on summons until a plea hearing next week, where he will be assessed for a community corrections order.

Whittaker will return to court on Monday.
